环境行政处罚措施

第一章总则

第一条[立法目的]为了规范环境行政处罚的执行,监督和保护环境保护主管部门依法行使职权,维护公共利益和社会秩序,保护环境。公民,法人或其他组织的合法权益,依照《中华人民共和国行政处罚法》及有关法律,法规制定。

第二条[适用范围]违反环境保护法律,法规,规章的公民,法人或者其他组织,应当给予环境行政处分,其依据是《中华人民共和国行政处罚法》和《中华人民共和国行政处罚法》。这些措施的执行程序。

第三条[处罚与教育相结合]实行环境行政处罚,坚持教育与处罚相结合,服务与管理相结合,指导和教育公民,法人或其他组织自觉遵守法律。

第四条【合法权益的维护】在执行环境行政处罚时,应当依法保护公民,法人和其他组织的合法权益,并保护有关的技术和商业秘密。交易对手应受到保护。

第5条[调查和起诉的分离]实施环境行政处罚,将调查和证据收集与决定性处罚分离,以及将决定性罚款和收取罚款分开。

第六条[管制自由裁量权]行政处罚自由裁量权的行使必须符合立法目的,应综合考虑以下情况:

(一)违规造成的环境污染,生态破坏和社会影响;

(二)双方的过失程度;

(四)违反的特定对象;

(五)该方是共犯还是屡犯?

如果类似违规的情况相同或相似,并且社会损害的程度是相等的,则行政处罚的类型和程度应相等。

第7条[不处罚的情况]如果违法行为是轻微的并及时得到纠正,并且不会造成有害后果,则不施加行政处罚。

第8条[回避情况]在下列情况之一中,案件发起人应避免:

(一)是此案涉及的当事方之一,或者是该当事方的近亲;

(二)在这种情况下,我或近亲有直接关系;

(三)法律,法规或规章要求的其他避免情况。

如果满足质疑条件,案件组织者应自行撤回,有关当事方也有权提出挑战。

第9条[适用的法律规则]一方同时违反两项或以上的环境法律,法规或规则,应以较高的效力适用法律,法规或规则;如果有效级别相同,则可以施加更严厉的处罚。

第十条[处罚类型]根据法律,行政法规和部门规章常用环境法律法规,环境行政处罚的类型为:

(一)警告;

([二)很好;

(三)停产整顿命令;

(四)订单以暂停生产,暂停业务并关闭;

([五)扣留,吊销许可证或其他许可证护照;

(六)没收违法所得,没收违法的赃物;

([七)行政拘留;

([八)法律和行政法规规定的其他类型的行政处罚。

第十一条【持续违法行为的认定和更正令】环境保护主管部门依法给予行政处分的,应当迅速发布行政令,责令当事人改正或者责令其改正。

如果在该期限内进行纠正的期限到期,并且当事方未能按要求进行纠正,并且违例仍在继续或持续,则可以将其确定为新的环境违规。

第12条[命令更正的方法]根据环境保护法律,行政法规和部门法规,对更正或对违法行为进行更正的行政命令的具体方法为:

第二十七条[调查和取证的协助]如果有必要委托其他环境保护部门协助调查和取证的,应当出具书面委托调查的信。

受委托的环境保护部门应提供协助。不能协助的,应当及时向委托机构报告失败的情况和原因。

第二十八条【现存的调查取证护照】调查取证时,不得有两名调查人员出示《中国环境监察证书》或其他行政执法护照。

第29条[调查者的权力]调查者有权采取以下行动:

(一)进入相关位置进行检查,调查,取样,记录,摄影和视频记录;

(二)要求当事方和相关人员解释相关事宜并提供相关材料;

环境保护部门组织的环境检测人员和其他技术人员有权采取上述措施,并在调查人员陪同下进行检测。

第30条[调查员的职责]调查员负有以下责任:

(一)对党的基本情况,违法事实,有害后果和违法情况进行全面,客观,及时和公正的调查;

(二)依法收集与案件有关的证据,不得使用暴力,威胁,诱使,欺骗或其他非法手段获取证据;

(三)在询问当事方,证人或其他有关人员时,应告知他们其合法权利;

(四)如实记录当事各方常用环境法律法规,证人或其他有关人员的发言。

第三十一条[调查合作方]当事人和有关人员应当配合调查,检查或者现场检查,如实回答问题,不得拒绝,阻挠,隐瞒或者提供虚假信息。

第32条[证据类别]环境行政处罚的证据主要包括书面证据,实物证据,证人证词,视听材料和计算机数据,当事人声明,监测报告和其他识别推论,现场检查(调查) )口供等。

证据应符合法律,法规,规章和最高人民法院关于行政执法和行政诉讼的证据,并经核实是确定事实的基础。

第33条[现场检查表白]检查相关物品或场所时,应做出现场检查(调查)声明,并可以使用照片,视频或其他方法记录现场情况。

第34条[现场检查和抽样]如果需要抽样,应进行抽样记录,或在现场检查(调查)表述中包括抽样过程,并可以记录抽样情况。拍照,录像或其他方法。

第三十五条【监测报告的要求】环境保护部门组织检查时,应当提出明确而具体的检查任务,并要求提交检查报告。

第36条[可以将在线测试数据作为证据]环境保护部门可以使用在线监视或其他技术监视方法来收集违规证据。环境保护主管部门认可的有效性数据可以作为判定违法事实的依据。

第三十七条[现场检测数据可以作为证据]对排污单位进行监督检测时,环保部门可以立即在现场取样,检测结果可以作为判断是否排污的依据。超过了标准。

第38条[证据的登记和保存]如果证据可能被破坏或丢失或以后无法获得,调查人员可以在代理机构负责人的同意下采取预先登记和保存的措施。

在紧急情况下,调查人员可以先采取注册和保存措施,然后报告给该机构的负责人以供批准。

要事先登记和保存相关证据,应当场计数,并由当事方和调查人员签发,签名或盖章。

在预先注册和保存期间,不得销毁,销毁或转让证据。

第39条[登记和保存措施及取消]对于预先登记和保存的证据,应在7个工作日内采取以下措施:

(一)根据情况,采取及时的证据保存措施,例如记录,复制,拍照和录像;

(三)根据相关法律法规,如果可以将其密封或暂时拘留,则决定将其密封或暂时拘留;

如果在7个工作日内未做出任何处理决定,则应手动取消预注册和保存措施。

第四十条[依法实施扣押和依法扣押]实施扣押,临时扣押等行政强制性措施,应当在法律,法规中有明确规定,应当告知当事各方有权申请进行行政复议和提起行政诉讼。

第四十一条[扣押和扣押的执行要求]被扣押或暂时扣押的当事双方的被盗物品应当场清点并出具清单,由调查人员和被告人签名或盖章。派对。

第五十五条【处罚决定的时限】环境保护行政处罚案件应当自立案之日起三个月内受理。办理年限不包括听证,公告,监督,鉴定和服务的时间。

第五十六条[处罚决定的送达]行政处罚决定应当下达给当事人,并根据需要复制到与案件有关的单位和个人。

第五十七条[服务形式]行政处罚文件可以直接服务,留置服务,委托服务,邮件服务,转寄服务,公告服务,公证服务或其他服务方式提供。方法。

第4章简单过程

第五十八条[简易程序的适用]违法事实是结论性的,情况属次要的,并确立了法定依据。对公民处以五十元以下的罚款,对法人或其他组织处以一千元以下的罚款或警告处以行政罚款。本章中的简化程序可用于当场作出行政处罚决定。

第59条[简易程序]当场作出行政处罚决定时,环境执法人员不得超过两名,并应遵循以下简单程序:

(一)执法人员应向有关当事方出示中国环境监察证书或其他行政执法护照;

(二)当场找出当事方的违法事实,并依法收集证据;

(三)向当事方说明违法事实,行政处罚的理由和依据,将要给予的行政处罚以及陈述和抗辩的权力;

([四)听各方的陈述和辩护;

(五)填写具有预定格式的行政处罚决定书,由环境保护部门编号并加盖公章,由执法人员签名或盖章,并将行政处罚决定书邮寄给当事人。点;

(六)通知当事方,如果他们不同意当场作出的行政处罚决定,则可以依法申请行政复议或提起行政诉讼。

执法人员当场作出的行政处罚决定,应当自决定之日起三个工作日内报环境保护部门备案。

第5章实施

第六十条[处罚决定的执行]当事人应在行政处罚决定规定的期限内执行处罚决定。

(一)After the administrative penalty decision is served, if the party does not apply for administrative reconsideration and does not initiate an administrative lawsuit, within 180 days from 60 days after the service of the penalty decision;

(二) If the party fails to initiate an administrative lawsuit after the reconsideration decision is served, within 180 days from 15 days after the service of the reconsideration decision;

(三) After the second-instance administrative ruling, if the party does not file for a retrial, within 180 days from 15 days after the ruling is served;

(四) After the second-instance administrative judgment, if the party does not file for a retrial, within 180 days after 10 days from the date of service of the judgment;

(五)Within 180 days from the date of delivery of the administrative ruling of the first instance.

Article 63 [Implementation after the reorganization of the assets of the punished enterprise] After the party has violated the regulations and is punished by fines, confiscation of illegal gains, or confiscation of illegal stolen goods, the division, merger, or other asset reorganization occurs In such circumstances, the legal person or other organization that bears the rights and obligations of the parties shall be the person subject to enforcement.

Article 64 [Delay or pay the fine in installments] If there are financial difficulties and it is necessary to postpone or pay the fine in installments, the party concerned shall do so before the expiration of the time limit for collection determined in the administrative penalty decision. The environmental protection department that issued the administrative penalty decision filed a written application for postponement or payment in installments.

If the party is approved to postpone or pay the fine in installments, a notice of agreeing to postpone the fine (in installments) should be prepared and served to the party and the institution that collected the fine. Delayed or delayed payment by instalments shall not be later than the deadline for applying for enforcement by the people’s court.

Article 65 [Handling of Confiscated Items] Illegal stolen goods confiscated according to law shall be handled in accordance with national regulations.

Destroyed items should be disposed of in accordance with relevant national regulations; if there are no regulations, with the approval of the person in charge of the environmental protection department, two or more environmental law enforcement officers shall supervise the destruction and prepare a destruction record.

Article 66 [Handover of Fines and Confiscated Money to the State Treasury] All fines and confiscated items shall be turned over to the State Treasury, and no unit or individual may embezzle, privately divide or embezzle in disguise.

Chapter 6 Filing and Filing

Article 67 [Case Closing] In any of the following circumstances, the case should be filed:

(一)The administrative penalty decision is fulfilled by the party concerned;

(二) The administrative penalty decision has been compulsorily executed according to law;

(三) No administrative penalties, etc. do not need to be enforced;

(四)The administrative penalty decision is revoked according to law;

(五) Other situations where the environmental protection authority feels that it can be filed.

Article 68 [File filing] For administrative penalty cases that are closed, the case materials shall be filed and filed in accordance with the following requirements:

(六)Other related materials.

Article 71 [Case Statistics] The competent environmental protection department shall improve the statistical system of administrative penalty cases, and report the administrative punishment of the administrative region to the higher-level environmental protection department in accordance with the relevant environmental statistics regulations of the Ministry of Environmental Protection.

Chapter 7 Supervision

Article 72 [Information Disclosure] Except for state secrets, technical secrets, commercial secrets, and personal privacy, administrative punishment decisions should be made public.

Article 73 [Supervision and Inspection] The environmental protection department at a higher level shall be responsible for the supervision and inspection of the administrative punishment of the environmental protection department at the lower level.

Article 74 [Punishment Filing] The environmental protection department should improve the administrative penalty filing system.

Punishment cases supervised by the lower-level environmental protection department against the higher-level environmental protection department shall be filed with the lower-level environmental protection department within 20 days after the case is opened.

Article 75 [Correction, Revocation, or Change] The competent environmental protection department discovers that the administrative penalty decision of the lower-level environmental protection department violates the regulations or is obviously ineffective by accepting the complaints and disclosures of the parties, or through the filing review and other means If it is fair, it should be urged to correct it.

After administrative reconsideration, the competent environmental protection department finds that the administrative punishment made by the competent environmental protection department at a lower level violates regulations or is obviously unfair, it shall be revoked or changed in accordance with the law.

Article 76 [Appraisal and Reward] The environmental protection department may appraise the administrative punishment work through case review or other forms. Units and individuals that have made obvious achievements in administrative punishment work may be rewarded and rewarded in accordance with relevant national or local regulations.

第8章附加条款

Article 77 [Determination of Illegal Income] All the income obtained by the party in violation of the regulations shall be paid to the party for reasonable expenses directly used in business activities, and shall be the income from the violation of regulations.

If laws, regulations or rules provide otherwise for the determination of "illegal income", those provisions shall prevail.

Article 78 [Division of Larger Fines] The "larger" fines and confiscations referred to in Article 48 of these Measures means RMB (or the value of equivalent items) above 5000 yuan for citizens , For legal persons or other organizations, it means RMB (or the value of equivalent items) above 50,000 yuan.

If local regulations and local government regulations have other provisions on the limits of "larger amounts" of fines and confiscations, those provisions shall prevail.

Article 79 [Period Regulations] The relevant period regulations of these Measures, except for the indicated working days (excluding holidays), other periods are estimated based on natural days.

The start date of the period is not included in the estimate. If the last day of the expiration of the period is a holiday, the first day after the holiday shall be the expiry date of the period. The period does not include the time in transit. If the administrative penalty document is mailed before the expiration date, it shall be deemed to be within the validity period.

Article 80 [Applicability of relevant laws and regulations] For other matters not stipulated in these Measures, the "Administrative Penalty Law", the "Measures for the Implementation of the Separation of Fines and Fines Separation", "Interim Provisions on Sanctions for Violations of Environmental Protection Regulations and Discipline", etc. Relevant laws, regulations and rules.

Article 81 [Exceptions to the Application of Nuclear Safety Penalties] Administrative penalties for nuclear safety supervision and management shall be implemented in accordance with the relevant state regulations on nuclear safety supervision and management.

Article 82 [Effective Date] These Measures shall be implemented on March 1, 2010.

The "Administrative Penalties for Environmental Protection" promulgated by the former State Environmental Protection Administration on August 6, 1999 shall be repealed at the same time.
